Terms of Service

Effective Date: January 21, 2025

1. Introduction

These Terms of Service ("TOS") govern the relationship between Brian Inman, a licensed real estate agent in Arizona ("Agent"), and any individual or entity ("Client") who engages Agent for real estate services. By engaging Agent, Client agrees to be bound by these TOS.

2. Services Offered, Agent offers a range of real estate services to Clients in Arizona, including but not limited to:

  • Buyer Representation: Assisting Clients in locating, evaluating, and purchasing real property.
  • Seller Representation:  Assisting Clients in marketing and selling real property.
  • Property Showings: Arranging and conducting property viewings for Clients.
  • Negotiation:  Negotiating offers and counteroffers on behalf of Clients.
  • Transaction Coordination:  Facilitating the closing process for real estate transactions.

3. Client Responsibilities, Client agrees to:

  • Provide Accurate Information:  Provide Agent with accurate and complete information regarding their real estate needs and financial situation.
  • Cooperate with Agent:  Be reasonably available for showings, respond promptly to communications, and cooperate with Agent in all aspects of the real estate transaction.
  • Comply with Laws:  Comply with all applicable laws and regulations related to real estate transactions in Arizona.

4. Fees and Payment

  • Commission:  Agent's compensation will be in the form of a commission, calculated as [clearly state your commission structure, e.g., a percentage of the sale price]. The commission is earned upon the successful closing of a real estate transaction.
  • Other Fees:  Client may be responsible for certain fees in addition to the commission, such as marketing expenses, transaction fees, and appraisal costs. These fees will be disclosed to Client in advance.
  • Payment Terms:  Commission and other fees are payable [specify payment terms, e.g., upon closing, within a certain number of days after closing].

5. Confidentiality

Agent will hold confidential all information received from Client in connection with the provision of real estate services, except as required by law or legal process. Client acknowledges that certain information related to the real estate transaction may need to be shared with other parties involved in the transaction, such as the other party to the transaction, lenders, and title companies.

6. Disclaimers and Limitations of Liability

  • No Guarantees:  Agent cannot guarantee a specific outcome, such as the sale of a property at a certain price or within a certain timeframe.
  • Errors and Omissions: Agent makes every effort to provide accurate information, but does not warrant the accuracy or completeness of any information provided.
  • Limitation of Liability:  Agent's liability to Client for any claims arising out of or related to the provision of real estate services shall be limited to the amount of commission received by Agent in connection with the transaction.

7. Termination

This agreement may be terminated by either party upon written notice to the other party. Grounds for termination may include, but are not limited to, breach of this agreement, failure to cooperate, or a material change in circumstances.

8. Governing Law and Dispute Resolution

This agreement shall be governed by and construed in accordance with the laws of the State of Arizona. Any dispute arising out of or relating to this agreement shall be settled through [specify dispute resolution method, e.g., mediation, arbitration].   


9. Entire Agreement

These TOS constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.   


10. Amendments

These TOS may be amended by Agent from time to time. Any amendments will be communicated to Client in writing.
